Why EBICS transfers are working with some banks using an expired certificate?

Some banks are refusing the transfer using the same expired certificates.

Resolution

There is nothing to prevent the use of an expired certificate when your are the requester.

The fact the transfer is accepted or not for such an expired certificate is related to the bank settings.
